Terms of Service

Welcome to Lumiere Wedding Planner. These Terms of Service ("Terms") govern your access to and use of the Lumiere Wedding Planner website, application, tools, templates, recommendations, timelines, dashboards, and related services (collectively, the "Service") provided by Lumiere HQ LLC ("Company," "we," "us," or "our"). By creating an account, accessing the Service, purchasing a paid feature, or using any part of the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who May Use the Service
You must be at least 18 years old and able to enter into a legally binding agreement to use the Service. By using the Service, you represent that you meet these requirements.
2. Account Registration and Security
You may need to create an account to use certain features. You agree to provide accurate information and keep your account information current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
Please notify us promptly at admin@lumiere-hq.com if you believe your account has been accessed without authorization.
3. Description of the Service
Lumiere Wedding Planner provides wedding planning tools that may include, depending on your plan and available features:
- Wedding profile setup
- Personalized planning dashboard
- Wedding checklist and task tools
- Timeline and milestone tools
- Day-Of Timeline Builder
- Rehearsal, wedding day, and day-after timeline tools
- Timeline Health scoring and recommendations
- Guest list and RSVP organization
- Vendor organization and vendor coverage checks
- Budget and payment tracking
- Inspiration boards and planning notes
- Uploaded file or contract extraction features
- Export and sharing tools
- Subscription, premium, planner, or venue features
The Service is designed to help organize wedding planning information. It does not guarantee a successful event, vendor performance, budget outcome, timeline outcome, legal result, financial result, or planning result.
4. Planning Guidance Disclaimer
The Service may provide suggested timelines, planning reminders, vendor-related prompts, budget guidance, RSVP organization, timeline warnings, travel buffers, room flip suggestions, sunset timing suggestions, vendor coverage checks, and other planning recommendations.
These recommendations are provided for informational and organizational purposes only. They are not professional wedding planning, legal, financial, accounting, tax, insurance, safety, transportation, or venue-management advice.
You are responsible for reviewing all recommendations, confirming details directly with your vendors and venue, and deciding whether a recommendation is appropriate for your event.
5. User Content and Wedding Data
You may submit, upload, or store information in the Service, including wedding details, guest information, vendor details, uploaded files, contracts, notes, inspiration items, images, RSVPs, budgets, and other content ("User Content").
You retain ownership of your User Content. By submitting User Content to the Service, you grant us a limited license to host, store, process, display, analyze, transmit, and use that User Content as needed to provide, maintain, secure, and improve the Service.
You represent that you have the rights, permissions, or other appropriate basis to submit User Content to the Service, including information about guests, vendors, wedding party members, family members, and other individuals.
6. Guest, Vendor, and Third-Party Information
If you enter or upload information about guests, vendors, wedding party members, family members, or other third parties, you are responsible for ensuring that you have permission or another appropriate basis to provide that information to the Service.
You agree not to use the Service to spam, harass, mislead, or unlawfully contact guests, vendors, or other individuals.
7. Uploaded Contracts and Files
The Service may allow you to upload contracts, PDFs, notes, images, documents, or other files. If the Service extracts dates, times, payment terms, setup windows, breakdown windows, vendor coverage periods, or other information from uploaded files, those outputs are provided for convenience only.
You are responsible for reviewing all extracted information for accuracy. We do not provide legal review, contract interpretation, or legal advice. You should consult an attorney for legal questions about contracts or vendor obligations.
8. AI and Automated Recommendations
The Service may use automated rules, algorithms, artificial intelligence, machine learning, or similar technologies to generate recommendations, summaries, warnings, timelines, categories, risk indicators, or other outputs.
Automated outputs may be incomplete, inaccurate, outdated, or inappropriate for your specific circumstances. You are responsible for reviewing and verifying all outputs before relying on them.
9. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, or abusive purposes
- Upload malware, harmful code, or content intended to compromise security
- Attempt to gain unauthorized access to the Service or another user's account
- Scrape, copy, reverse engineer, decompile, or misuse the Service
- Upload content that infringes another person's rights
- Upload private information without appropriate permission
- Use the Service to send spam or unwanted communications
- Interfere with the security, integrity, or operation of the Service
- Misrepresent your identity or affiliation
- Use the Service to develop or train a competing product in violation of these Terms
10. Intellectual Property
The Service, including our software, design, branding, trademarks, templates, original content, workflows, feature names, visual design, and platform materials, is owned by Lumiere HQ LLC or its licensors and is protected by intellectual property laws.
These Terms do not transfer ownership of our intellectual property to you. You may use the Service only as permitted by these Terms.
11. Feedback
If you provide suggestions, ideas, comments, bug reports, feature requests, or other feedback, you grant us a perpetual, worldwide, royalty-free, transferable, sublicensable license to use that feedback for any purpose without compensation or obligation to you.
12. Subscriptions, Purchases, and Paid Features
Certain features may require payment. Paid plans may include one-time purchases, subscriptions, add-ons, exports, planner tools, venue tools, or other premium features.
You agree to pay all applicable fees and taxes. Prices, features, and plan availability may change over time. We will provide notice where required by law.
If a recurring subscription is offered, your subscription may renew automatically unless you cancel before the renewal date.
Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are additionally governed by the Paddle Checkout Buyer Terms, available at https://www.paddle.com/legal/checkout-buyer-terms.
13. Refunds and Cancellations
Refunds and cancellations are governed by our Refund & Cancellation Policy, available at /legal/refund-policy.
14. Third-Party Services
The Service may integrate with or link to third-party services, including payment processors, email providers, analytics providers, hosting providers, map tools, calendar tools, AI providers, or vendor websites. We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.
15. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the Service, you acknowledge our Privacy Policy, available at /legal/privacy.
16. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect the Service and personal information. However, no system is completely secure. You are responsible for using a secure password, protecting your login credentials, and promptly notifying us of suspected unauthorized access.
17. No Warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
We do not guarantee that the Service will be uninterrupted, error-free, secure, accurate, or available at all times.
18. Limitation of Liability
To the maximum extent permitted by law, Lumiere HQ LLC and its officers, directors, employees, contractors, agents, affiliates, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, wedding-related losses, vendor disputes, event disruptions, or substitute service costs.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to us for the Service in the twelve months before the event giving rise to the claim, or $100 if you have not paid us.
19. Indemnification
You agree to defend, indemnify, and hold harmless Lumiere HQ LLC and its officers, directors, employees, contractors, agents, affiliates, and licensors from any claims, damages, liabilities, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of another person's rights.
20. Termination
We may suspend or terminate your access to the Service if you violate these Terms, create risk for us or other users, fail to pay required fees, or use the Service in a way that may cause harm.
You may stop using the Service at any time. Account deletion and data request options are described in our Data Requests page.
21. Changes to the Service or Terms
We may update the Service or these Terms from time to time. If changes are material, we will provide notice through the Service, email, or another reasonable method. Continued use of the Service after changes become effective means you accept the updated Terms.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Before filing a legal claim, you agree to contact us at admin@lumiere-hq.com so we can attempt to resolve the issue informally.
Any legal action will be brought in the state or federal courts located in Franklin County, Missouri, unless otherwise required by applicable law.
